Jacobson Confirmed As 2008 Junior National Heavy Australian Champion

The AKA website karting.net.au reports that Gary Jacobson has finally been crowned the official winner of Junior National Heavy at the Australian Sprint Kart Championships held at Easter.

The Australian Motor Sport Appeals Court (AMSAC) yesterday denied the Application to Appeal that was lodged by Nathan Morcom on 20 October 2008, therefore Jacobson is officially the 2008 Junior National Heavy Australian Champion.

Following the National Championship Final in Launceston, Jacobson lodged a complaint alleging that coming into the last corner of the race Morcom’s kart contacted the back end of his and pushed it off the track.

The Stewards of the meeting considered the complaint and determined that there had been a breach of Rule 16.13(a) – Contact of Karts – and revised the finishing order of the pair to be Jacobson first and Morcom third.

Morcom then appealed against the Stewards’ finding and at a hearing conducted on 28 April 2008 the Appeals Tribunal dismissed the Appeal. This decision was then appealed by Morcom to the Australian Karting Appeals Court (AKAC) which conducted a hearing on 11 September 2008. This Appeal was dismissed by AKAC while confirming the finding and the penalty of the AKA Appeals Tribunal.

A subsequent Appeal was received by AMSAC on 20 October 2008, however, the time limit of an Appeal being lodged to AMSAC is seven (7) days on which the appealed against was given (18 September 2008 in this case). Therefore Morcom’s Appeal to AMSAC was denied.
